but they will be from another test playing nation - and as there are no others so far in the EU, that would still to be tested?

I think under EU rules they wont be able to be classed as overseas players as it would be an illegal restraint of trade.

None of them are really good enough to be signed as overseas either, so their test chances would die immediately.

Who would you rather have Nial O'Brien or Sarwan ? Porterfield or Jeetan Patel ?

The fact that Morgan and Joyce have been able to switch nationality would suggest they wouldn't be overseas.

don't think its as simple as that

i'm sure the overseas player quota has got little to do with any international laws in the first place , its more an agreement between the counties and the ECB on what limits they will have. so under current rules they would be classed as overseas players, they only get around that atm because there is leeway applied for associate countries.

if Ireland were to get test status they would then be considered overseas players but a player or county could in theory challenge that but it would require a ruling from the EU courts that the quota was illegal in the same way that the kolpak ruling came into place to begin with

Counties get ECB money based on how many England qualified players they have. If Irish players are not available to England, I suppose that would cost the county?

The one thing I've never understood is how Kolpak players and Overseas players can come from the same country depending on their commitment to playing international cricket.

One would assume the same would apply to the Irish.

The ECBs rules specify that a domestic player can not play for another full member internationally.

I reckon it would eventually be deemed restraint of trade and the EU courts would side with the players.

Wouldn't Eire need a First Class system in place to get Test status?

it would still require someone to bring a case in front of the EU courts and a ruling to be made , which would require proof that they had been turned down for a contract on the basis of an "illegal" quota

if the counties are happy to play along with the quota on overseas players , and they are unlikely to rock the boat with the ECB as they depend on the ECB financially, then it could be hard to get a test case to begin with

Sean Ervine plays as a domestic cricketer, a status he would have lost had he decided to play for ZImbabwe in the last world cup.

Yep. Get money from no of players available for Eng and for those that actually play for England.

Last year Middlesex earned £250,000 from Morgan, Finn and Strauss appearing for England and said in their annual report that it would be a huge blow if anything happened. Morgan promptly lost his test place and Strauss retired. Oops.
