I’d agree with Footman’s logic there.

Opinion appears to be divided in FTECB as to whether Stokes should be given a NOC to play in IPL.
From mailonline:-

"However, Fairbrother is said to be exasperated at the conflicting messages he has received from the ECB over the all-rounder's position

It's understood to have moved from supportive to dismissive after the Ashes were lost with different executives having different opinions.
The role of numerous lawyers involved in the Stokes case can't have helped Fairbrother keep in full control of the saga and the Crown Prosecution Service dragging their feet on whether to charge Stokes has complicated matters further.
The relationship between Fairbrother and the ECB is a critical one as the former Lancashire batsman also represents England captain Joe Root, as well as Stuart Broad, James Vince, Jos Buttler and Mason Crane."

Typical FTECB. The Ashes defeat should have no impact on their attitude - and they were the ones decided Stokes couldn't play.
I think it's vital for Stokes to be playing competitive cricket , if he does not play for England in the ODI series in Australia or the NZ tour he'll have had about half a year out of action apart from a few weeks in NZ domestic cricket.
Although I'd love to see him at Durham at the start of next season I suspect he might be better off ( no pun intended!) playing alongside world class players in the IPL rather than on the county circuit in the first few weeks of the season. That's assuming the CPS decision will be 6-12 months away and FTECB insist on not selecting him for England in the meantime.

It would be absolutely ridiculous for the ECB to allow one of their players to play in the highest profile cricket tournament in the world if they view him as being ineligible to represent their team due to off field issues. The ECB are Stokes’ employers, if he is not eligible for selection for England then he should be ineligible to play any competitive cricket.

That would be the logical decision - all or nothing but as usual the ECB have made a mess of it. Tom Harrison has pretty much confirmed Stokes will play in the IPL : " I imagine having given him a NoC to play in New Zealand, it will be difficult for us to say on balance that we would not apply the same thinking to the playing in other parts of the world."
The rest of the quote seems gibberish to me! "But the NoC is based on a particular tournament. If we want board backing for a decision such as this, and this has been hugely complicated and board backing for a decision of this magnitude might not be a bad idea, then the implications of it (the game’s reputation) is something we have to work out.”

Yep. The ECB have set one of their beloved precedents by letting Stokes play in New Zealand domestic cricket so they surely could not conjure up an excuse for not letting him play in the IPL.

By the time IPL comes round if the issue hasn't been resolved then Stokes will not have played any red ball cricket for 6 months. A fairly plausible reason for withholding a NOC would be for ECB to state that they wanted him to play CC with Durham as preparation for the test summer's series.
That would be a sanction which would appease the dissenting voices at ECB because in effect it's fining Stokes his substantial IPL fee.
Whether that would be acceptable to Stokes and his representatives is another question particularly with so many England players also with agent Fairbrother not least Stokes big mate the England captain.
This could get very nasty. In fact this could really FTECB

Yep. Has the potential to blow up in their faces. There have already been stories that Fairbrother is not happy with the way FTECB have handled the situation. There was a tweet the other day from Mike Selvey who seemed to be saying FTECB could not refuse to give him a NoC despite him being under central contract. Selvey said he had asked about the situation and was told ( although he didn't say who he had asked) that because FTECB are preventing Stokes playing for England they can not legally prevent him playing elsewhere.
They could give strong 'advice' and maybe issue veiled threats but that could permanently damage relations between player and board.

I see Malan is set to replace Stokes in the ODI squad. According to The Telegraph Ben will continued to be named in England squads " with an asterisk against his name." What a farce!

There was another story that caught my eye - an "influential" board member is supposedly insisting Stokes receives a harsh punishment from FTECB once the disciplinary process begins.
http://www.dailymail.co.uk/sport/cricke ... ember.html

Surely they are not going to give him a lengthy international ban in addition to the games he'll already have missed. Even a harsh punishment of , say , a 5 test ban and several ODI's will have been served if the disciplinary process took part immediately after this tour - and in all likelihood it won't.
I'd have thought any ban would be backdated and include the games he's already missed.
