Whether they should have made that decision in the first place is another matter - why could they not have left their options more open and retained him in the original squad. You have to wonder what would have happened had the Sun not got hold of that video. At most a police caution a few days after the incident ,I suspect, and the incident now forgotten with Stokes part of the Ashes set up. I'm in no way condoning Stokes' action but nor will I condemn him until I know all the facts. It 's pretty obvious now that the police and CPS are each passing the buck waiting for the other to make the decision knowing that whichever way it goes there'll be criticism from the media. That equates to the media influencing the justice system and that should be a big concern to all.

I totally agree. The Mirror has a story that again speculates he will play in the 3rd Ashes test but also says he "could" be charged but the court case would be months away.

If he does play for Canterbury he could , ironically , replace a player who has been suspended ... for assault! Although the key difference is the Kiwi player has admitted the charge.

Mike Atherton ( Times online ) has written an article lambasting FTECB for looking as if they have lost control over the Stokes incident. Athers says if he has been given permission to play domestic but not international cricket how would it look if he ended up playing in the Big Bash whilst England were contending the Ashes "down the road."

Most unlike FTECB to make a complex situation even more confusing!

So the police have passed a file on to the CPS and are " seeking charging advice." Not sure if that's good news for him because presumably the police could have decided to end the investigation without seeking such advice?

Maybe it's just a high enough profile case that people feel they have to dot all of the i s and cross all of the t s.

Botham lambasting FTECB "dinosaurs" for not selecting Stokes.
The ECB is full of dinosaurs because the law of the land is you are innocent until proven guilty. ‘The law is not the ridiculous rules and ideas of the ECB. Ben Stokes is box office…and that’s what attracts supporters to cricket.’

The farce may not be over either - it appears as if FTECB are going to select him in the ODI squad whilst also sticking to their line about not letting him play until they know the outcome of the CPS decision. So that surely must mean he could be picked in the squad but not considered for selection!
