Having said that, it does strangely feel to me like there is truth in it.

The apology was bizarre when MacKay settled outside court.
The sacking was also bizarre, you don't think of successful businessmen being so irrational.

The cherry on the top though is the Norwich job. He seemingly had that one wrapped up until the very last minute, when something put Norwich off hiring him... maybe it was the disclosure of this?

And additionally, the bloke involved at Palace has just resigned over it, and it seems Palace didn't hire MacKay because of it too....

This is becoming ridiculous. The media don't seem to be able to see that this Cardiff v Malky thing is just a rouse for a character assassination, based on the fact that his wrongful sacking at Cardiff left eggs on the faces. By all accounts, they trawled through 10,000's of text messages to find three that contained regrettable language.....

Vincent Tan is a mentalist, surely we should not allow a calculated public vendetta to cloud the judgement on this?

It doesn't matter if they went through a billion texts and found 1 racist one, they deserve to be exposed and punished.

The reason they went through Moodys house and found the texts/e-mails is because they think they defrauded the club.

Neither should be allowed near football again.

So a guy sacks two people, at the time remember the criticism that this decision received from the press and public, and was made to look like a mad despot.

In return, the person in question manages to get accuse both of defrauding him, and has his personal investigators raid their house as part of the investigation, after which they have their personal correspondence scrutinised. While the reasons for this investigation had NOT been validated, as neither have been charged for fraud, these personal comments taken as part of the investigation are then deemed, as per the person who has just sacked the two and is probably going to get hit for unfair dismissal, to be needed to be disclosed to the FA on public interest grounds. They chose the day before MacKay took another job to release these, therefore debarring him from taking employment.

The reason for these texts being scrutinised and the reasons why Cardiff held them in the first place are not backed by any legal charge...... Cardiff seem to have made an accusation, to which as part of that accusation they received another condemning evidence to get revenge on a former employee, and have calculated the release of this information at the most damaging time.

If I was to get you sacked from a job by claiming you had raped me, then subsequently as part of the investigation released details of the fact you called your boss a *modded* to a colleague on your personal mobile phone, on the grounds that such malpractice had to be reported to your employer, then would you feel fairly treated?

This is utter BS, Powelly. Its against justice. What a person says in private is private, and a FRAUD investigation should not be used to collate, and then release, personal correspondence that has NO LINK to that fraud accusation.

If it is subsequently found that Cardiff released this to the press, then they should be relegated to the Conference... releasing details of an unproven criminal investigation to another, and leaking to the press just to enact revenge, is shoddy.

It's amazing how anyone can gauge a view based on a few text message containing a few slurred words.

If Malky McKay was inciting racial hatred during his tenure as a coach then the outcries are justified, but these messages are obviously from private conversations that were never meant to be in the public domain. Harry Redknapp and Clarke Carlisle have summed their views up rather well.

Telling the press your boss has basically just sacked you is not really "leaking", it simply telling the truth. MacKay was party to the communication, and therefore could also be seen as an interested party in its communication, in fact, the sole interest as it was discussing his job performance.... he had little to gain from it other than being made unemployed.

Obtaining personal communications based on the investigation of an as yet proved, or even charged or criminally investigated crime, and then releasing this evidence to both a third party, while leaking it to the press on the day the person in question is about to finally get a job, is quite different. It was calculated in obtaining the evidence, it was calculated how and when it was used against the person, and hardly smacks of justice.

Mackay being a racist, sexist, homophobic bigot is the only issue here.

Whilst hes being investigated for fraud, he shouldn't be taking another job, if it was Vincent Tan who leaked this, good on him.

Had Cardiff sat on this info, Mackay then got the Palace job, then it eventually came out ( the truth always does ), people would be taking a pop at Vincent Tan for allowing him to get another job elsewhere, can't win.

Indeed. Its definitely in the public interest that an employee who wrongly sacked you can then send his private investigators to your home afterwards, take your laptop and mobile phone, and trawl through 100,000's of stream of data looking for when you said something unsavoury to someone, IN PRIVATE!!!!! AND WHEN SUCH AN INVESTIGATION DID NOT LEAD TO A CRIMINAL CHARGE BEING LEVIED ON SAID PERSON!!

Racism, etc, is a crime.... but so is abusing the right to privacy of another person, and two wrongs do not make a right.

They went into their homes because there was enough evidence for foul play, and the investigation isn't over yet.

They didn't raid his house on hearsay. How can you say he was unfairly sacked ? Maybe Tan heard him say something racist, remember Mackay dropped his unfair dismissal claim pretty quickly AND issued a public apology to Tan.
